Privacy policy
We are delighted about your interest in our company. Data protection is particularly important to the management of YOUNGSTAR TRAVEL GmbH. In principle, you can use the websites of YOUNGSTAR TRAVEL GmbH without providing any personal data. However, if a data subject wishes to make use of special services offered by our company via our website, the processing of personal data may become necessary. If the processing of personal data is necessary and there is no legal basis for such processing, we generally obtain the consent of the data subject.
The processing of personal data, for example the name, address, email address or telephone number of a data subject, always takes place in accordance with the General Data Protection Regulation and in compliance with the country-specific data protection provisions applicable to YOUNGSTAR TRAVEL GmbH. With this privacy policy, our company would like to inform the public about the nature, scope and purpose of the personal data we collect, use and process. Furthermore, this privacy policy informs data subjects of the rights to which they are entitled.
As the controller, YOUNGSTAR TRAVEL GmbH has implemented numerous technical and organisational measures to ensure the most complete protection possible for the personal data processed via this website. Nevertheless, internet-based data transmissions can in principle have security gaps, so absolute protection cannot be guaranteed. For this reason, every data subject is free to transmit personal data to us by alternative means, for example by telephone.
1. Definitions
The privacy policy of YOUNGSTAR TRAVEL GmbH is based on the terms used by the European legislator when adopting the General Data Protection Regulation (GDPR). Our privacy policy is intended to be easy to read and understand for the public as well as for our customers and business partners. To ensure this, we would like to explain the terms used in advance.
In this privacy policy, we use the following terms, among others:
-

Personal data means any information relating to an identified or identifiable natural person (hereinafter “data subject”). An identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.

A data subject is any identified or identifiable natural person whose personal data is processed by the controller.
-

-
d) restriction of processing
Restriction of processing is the marking of stored personal data with the aim of limiting its future processing.
-
e) profiling

-
f) pseudonymisation
Pseudonymisation is the processing of personal data in such a manner that the personal data can no longer be attributed to a specific data subject without the use of additional information, provided that such additional information is kept separately and is subject to technical and organisational measures to ensure that the personal data are not attributed to an identified or identifiable natural person.
-
g) Controller or controller responsible for the processing
The controller or controller responsible for the processing is the natural or legal person, public authority, agency or other body which, alone or jointly with others, determines the purposes and means of the processing of personal data. However, public authorities which may receive personal data in the framework of a particular inquiry in accordance with Union or Member State law are not regarded as recipients.
-
j) Third party
A third party is a natural or legal person, public authority, agency or body other than the data subject, the controller, the processor and persons who, under the direct authority of the controller or processor, are authorised to process personal data.
-
k) Consent
Consent is any freely given, specific, informed and unambiguous indication of the data subject's wishes, by a statement or by a clear affirmative action, by which the data subject signifies agreement to the processing of personal data relating to them.
2. Name and address of the controller responsible for the processing
The controller within the meaning of the General Data Protection Regulation, other data protection laws applicable in the Member States of the European Union and other provisions with a data protection character is:
YOUNGSTAR TRAVEL GmbH
Am Kuhlerbusch 2a
51469 Bergisch Gladbach
Germany
Tel.: 02202-37457
Email: info(at)youngstar-travel.de
Website: www.youngstar-travel.de
3. Collection of general data and information
Each time the website of YOUNGSTAR TRAVEL GmbH is accessed by a data subject or an automated system, it collects a series of general data and information. This general data and information is stored in the server's log files. The following may be collected:
(1) the browser types and versions used,
(2) the operating system used by the accessing system,
(3) the website from which an accessing system reaches our website (so-called referrers),
(4) the sub-pages which are accessed on our website via an accessing system,
(5) the date and time of access to the website,
(6) an Internet Protocol address (IP address),
(7) the internet service provider of the accessing system and
(8) other similar data and information that serve to avert danger in the event of attacks on our information technology systems.
When using this general data and information, YOUNGSTAR TRAVEL GmbH does not draw any conclusions about the data subject. Rather, this information is needed to
(1) to deliver the content of our website correctly,
(2) to optimise the content of our website and the advertising for it,
(3) to ensure the long-term functionality of our information technology systems and the technology of our website, and
(4) to provide law enforcement authorities with the information necessary for prosecution in the event of a cyber attack. YOUNGSTAR TRAVEL GmbH therefore evaluates this anonymously collected data and information, on the one hand, for statistical purposes and, on the other, with the aim of increasing data protection and data security in our company, so as to ultimately ensure an optimal level of protection for the personal data we process. The anonymous data of the server log files is stored separately from all personal data provided by a data subject.
7. Contact options via the website
Due to statutory provisions, the website of YOUNGSTAR TRAVEL GmbH contains details that enable quick electronic contact with our company as well as direct communication with us, which also includes a general address for so-called electronic mail (email address). If a data subject contacts the controller by email or via a contact form, the personal data transmitted by the data subject is stored automatically. Personal data transmitted to the controller by a data subject on a voluntary basis in this way is stored for the purposes of processing the enquiry or contacting the data subject. To deliver the message, we use the email service provider Mailgun (see below under "Enquiries via form").
Storage period of enquiries via the enquiry form. We process the data you send us via our enquiry forms (school trip, group trip, family holiday) in order to handle your enquiry and prepare a quote. The enquiry data is stored for the duration of processing and to fulfil statutory retention obligations, and is automatically deleted no later than 24 months after receipt, unless statutory retention periods prevent this or a contractual relationship is established. The legal basis is Art. 6 para. 1 lit. b and f GDPR.
Services on the new website
The following information applies to the new website (GREATcms). It supplements this privacy policy with the services that actually run there.
Booking via camps.digital
On our trip pages that include a booking form, we embed the form from the provider camps.digital so that you can see dates and prices and enquire about or book a trip online. The provider is wirtschaftswunder.digital GmbH, Leostr. 68, 40547 Düsseldorf.
When you open such a trip page, your browser connects to pf.camps.digital as soon as the page loads. In particular, your IP address and technical device and browser information are sent to the provider. The form loads without an extra click beforehand. We do not obtain separate consent for this.
The legal basis for the processing is Art. 6 para. 1 lit. b GDPR (initiating or performing a travel contract) and Art. 6 para. 1 lit. f GDPR (legitimate interest in showing you the booking option directly alongside the offer). Where a connection to this third-party provider is established or information on your device is accessed in the process, we additionally rely on § 25 TDDDG — not on consent under § 25 para. 1 TDDDG.
The recipient of the technical data transmitted is wirtschaftswunder.digital GmbH. What the provider processes beyond that within the form is governed by its own privacy policy: https://www.camps.digital/datenschutz. We have no full influence over this processing once the connection is established.
On the Teamer and Jobs pages, links lead, after you click them (new window), to the application form at my.camps.digital, run by the same provider. The connection is only made there once you click the link.
Provider's storage location: Germany.
Images and videos (Bunny)
Images on this website are delivered via the Bunny CDN (address media.youngstar-travel.de) as soon as a page with images loads. Videos only run via iframe.mediadelivery.net where a video has been added.
Provider: Bunny Way d.o.o., Cesta komandanta Staneta 4A, 1215 Medvode, Slovenia.
Purpose: fast, secure delivery of images and videos. Your IP address is technically necessarily transmitted to the provider in the process. No tracking cookies are set for advertising purposes. Delivery takes place within the EU.
Legal basis: Art. 6 (1) lit. f GDPR. Where § 25 TDDDG applies: technically necessary delivery of the page content you have requested (§ 25 (2) TDDDG).
Recipient: Bunny Way d.o.o., engaged as a sub-processor of our technology partner GREATsolution. No third country.
Google Analytics and Google Tag Manager
With your consent, we use Google Analytics 4 to understand how our website is used and which pages and booking steps work well (reach measurement). The provider is Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland ("Google").
We integrate Google Analytics via Google Tag Manager, also a service of Google Ireland Limited. The Tag Manager is used to deploy the analytics tags on the website; it does not set any cookies itself and does not evaluate any data, but your IP address is technically transmitted to Google when it loads. Tag Manager and Google Analytics are only loaded once you agree in the cookie banner. Until then, no request is sent to Google.
After you agree, Google Analytics sets cookies (in particular "_ga" and "_ga_<Container-ID>") with a lifetime of up to 2 years and processes information about the pages and booking steps viewed, your browser and device, your approximate location and your IP address.
The usage data stored in Google Analytics is deleted after 2 months. Google processes the data on our behalf on the basis of a data processing agreement.
Consent is voluntary; without it, you can still use the website in full.
The legal basis is your consent pursuant to § 25 (1) TDDDG and Art. 6 (1) lit. a GDPR. You can withdraw your consent at any time with effect for the future via the "Cookie settings" link in the footer of the website. The lawfulness of the processing carried out until withdrawal remains unaffected.
Data transfer to the USA: Data may be transferred to Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA. Google LLC is certified under the EU-US Data Privacy Framework. The transfer is therefore covered by an adequacy decision of the European Commission of 10 July 2023 (Art. 45 GDPR). In addition, Google bases the transfer on the EU Commission's standard contractual clauses.
You can find more information in Google's privacy policy: https://policies.google.com/privacy
Marketing services: Meta Pixel, TikTok Pixel and Google Ads
With your consent, we use three marketing services. We use them to measure the effectiveness of our advertising (conversion tracking) and to address visitors to our website again later (remarketing). The services are integrated via Google Tag Manager and are only loaded once you activate the category "Marketing" in the cookie banner. Until then, no request is sent to the providers.
Meta Pixel. The provider is Meta Platforms Ireland Limited, Merrion Road, Dublin 4, D04 X2K5, Ireland ("Meta"); the pixel ID is 702743288993484. After you agree, the Meta Pixel sets cookies (in particular "_fbp") and transmits your IP address, information about your browser and device, the page viewed and the cookie identifier to Meta. This allows Meta to match our ads on Facebook and Instagram to your visit and to show you ads again later.
TikTok Pixel. The provider is TikTok Technology Limited, 10 Earlsfort Terrace, Dublin, D02 T380, Ireland ("TikTok"). After you agree, the TikTok Pixel sets cookies (in particular "_ttp") and transmits your IP address, information about your browser and device, the page viewed and the cookie identifier to TikTok. This allows TikTok to match our ads to your visit and to show you ads again later.
Google Ads (conversion tracking and remarketing). The provider is Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland ("Google"). After you agree, Google Ads sets cookies (in particular "_gcl_au") and processes your IP address, information about your browser and device and the pages viewed. With the conversion linker, Google matches a booking to the ad through which you reached our website. For remarketing, Google adds you to an audience so that we can show you ads again later.
When you complete a booking, we transmit only the booking number, the booking value and the currency to the three services. We do not pass on names, email addresses or other contact details. Functions for enhanced data matching (Advanced Matching, Enhanced Conversions, Conversions API) are switched off.
The providers partly process the data for their own purposes as well, for example to improve their advertising systems. We have no influence on this processing. We are jointly responsible with Meta (Art. 26 GDPR) for the collection and transmission of data via the Meta Pixel. Under the joint controllership agreement, Meta fulfils the information obligations and handles data subject requests regarding processing after the data has been collected. The same applies to the TikTok Pixel, to the extent that TikTok offers a corresponding joint controllership agreement. You can assert your rights against us as well as against the providers.
Consent is voluntary; without it, you can use the website in full.
The legal basis is your consent under § 25 (1) TDDDG and Art. 6 (1) (a) GDPR. You can withdraw your consent at any time with effect for the future via the link "Cookie settings" in the footer of the website. The lawfulness of processing carried out before withdrawal remains unaffected.
Transfer to third countries: Data may be transmitted to Meta Platforms, Inc. and Google LLC in the USA. Both companies are certified under the EU-US Data Privacy Framework, so an adequacy decision of the European Commission of 10 July 2023 applies to these transfers (Art. 45 GDPR). In the case of TikTok, data may be transmitted to the USA and, according to the provider, also to China and other third countries, or may be accessible there. For these transfers, TikTok relies on standard contractual clauses of the EU Commission (Art. 46 (2) (c) GDPR). In some of these countries, authorities may access the data and you may not have legal remedies comparable to those in the EU.
The cookies of the services generally have a lifetime of up to 13 months. The data stored by the providers is deleted by them according to their own retention periods.
Further information can be found in the providers' privacy policies: Meta: https://www.facebook.com/privacy/policy, TikTok: https://www.tiktok.com/legal/page/eea/privacy-policy/en, Google: https://policies.google.com/privacy
Google Maps
On some pages we embed maps from the Google Maps service to show you how to get to our accommodation. The provider is Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland ("Google").
The map is not loaded automatically. Only when you actively click "Load map" is the map loaded from Google. By clicking, you consent to the data transfer. Google then processes in particular your IP address, information about your browser and device and, where applicable, other data stored in cookies in order to display the map. We have no influence over this processing by Google.
The legal basis is your consent pursuant to § 25 (1) TDDDG and Art. 6 (1) lit. a GDPR. You can withdraw your consent at any time with effect for the future by reloading or leaving the page. The lawfulness of the processing carried out until withdrawal remains unaffected.
Data transfer to the USA: When the map is loaded, data may be transferred to Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA.
Enquiries via form (Mailgun)
When you submit our enquiry or contact form, our servers forward the message via the email service provider Mailgun so that we can receive and answer it. Provider: Mailgun Technologies, Inc. (Sinch Email). Sending is done via the EU endpoint api.eu.mailgun.net. Your browser does not connect to Mailgun.
Legal basis: Art. 6 (1) lit. b and lit. f GDPR.
Recipient: Mailgun Technologies, Inc., engaged as a sub-processor of our technology partner GREATsolution. Processing takes place in the EU. § 25 TDDDG does not apply here (Mailgun does not access your device).
The storage period for enquiry data is already set out in the paragraph directly after Section 7 and continues to apply.
Newsletter (Brevo)
You can subscribe to our newsletter in the footer of our pages. This is voluntary. In it, we let you know about new trips, discount offers and news from our houses. Only your email address is required; without it we cannot send you the newsletter. Your first name is optional and is used to address you personally. The newsletter is aimed at adults and young people aged 16 and over. If you are younger, please only subscribe with your parents' consent.
We use the email service Brevo to send the newsletter (Sendinblue GmbH, Köpenicker Str. 126, 10179 Berlin, Germany; Brevo group of companies headquartered in France). Our servers send your details directly to Brevo; your browser does not connect to Brevo when you subscribe.
We use the double opt-in procedure: after you submit the form, you will receive an email with a confirmation link. You are only subscribed once you click it; without confirmation, we will not send you a newsletter. To prove your consent (Art. 7 Abs. 1 DSGVO), we log your subscription and confirmation with the respective time. Technical details such as the IP address from which the confirmation is made may also be stored.
You can also subscribe to the newsletter by ticking a box in the camps.digital booking form. The tick box is voluntary and not a condition of booking. Your email address (and, if applicable, your first name) will then be added to our recipient list at Brevo. Everything stated in this section applies to this subscription.
By subscribing, you also consent to us using Brevo to evaluate whether you have opened a newsletter and which links you have clicked, in relation to your email address. For this purpose, the email contains a small tracking image, and links are redirected via Brevo. We use this to improve the newsletter. The legal basis is Art. 6 Abs. 1 lit. a DSGVO and § 25 Abs. 1 TDDDG, because your device is accessed in the process. You can withdraw this consent at any time by unsubscribing from the newsletter. You can also prevent the open tracking by turning off the automatic loading of images in your email programme.
The legal basis for sending the newsletter is your consent, Art. 6 Abs. 1 lit. a DSGVO, § 7 Abs. 2 Nr. 3 UWG. We process the proof of consent on the basis of our legitimate interest in being able to document consent and defend against claims, Art. 6 Abs. 1 lit. f DSGVO.
Withdrawal: You can withdraw your consent at any time with effect for the future, using the unsubscribe link in every newsletter email or by sending a message to info(at)youngstar-travel.de. The lawfulness of any processing carried out up to that point remains unaffected.
Storage period: We store your details until you unsubscribe. After that, we only keep what we need in order not to contact you again by mistake and to prove your earlier consent: your email address on a block list and the times of subscription, confirmation and unsubscription. We delete this information three years after the end of the year in which you unsubscribed (Art. 6 Abs. 1 lit. f, Art. 17 Abs. 3 lit. e DSGVO).
Recipients and data processing: The recipient of your data is Brevo. Brevo processes the data on our behalf on the basis of a data processing agreement under Art. 28 DSGVO. According to Brevo, the data is generally processed on servers in the EU. Brevo uses its own sub-processors. If data is transferred to a country outside the EU or the EEA in the process, this only happens on the basis of an adequacy decision (Art. 45 DSGVO) or suitable safeguards such as the EU standard contractual clauses (Art. 46 DSGVO). The current list of sub-processors can be found in Brevo's contract documents; we will provide it to you on request.
Visitor numbers (Umami)
We use Umami for the statistical analysis of website usage (page views, rough technical characteristics). The script comes from our own address (/a/s.js) and runs on our servers at Hetzner in Germany (operated by GREATsolution). Umami does not set any cookies, does not store full IP addresses for profiling purposes and does not pass the data on to third parties. No user-related profile is created across several websites.
Legal basis: Art. 6 Abs. 1 lit. f DSGVO. We do not obtain consent under § 25 Abs. 1 TDDDG for this, because no cookies are set and no non-essential device information is read for tracking purposes.
No consent banner solely for this service.
Hosting (Hetzner)
This website is operated by our technology partner GREATsolution on servers of Hetzner Online GmbH, Industriestr. 25, 91710 Gunzenhausen, Germany (server location: Germany). When you visit the site, the server processes technically necessary access data (including IP address, time, page accessed, browser type) for delivery and operational security.
Legal basis: Art. 6 (1) lit. f GDPR. Recipient: Hetzner Online GmbH. No third country.
8. Routine erasure and blocking of personal data
The controller processes and stores the personal data of the data subject only for the period necessary to achieve the purpose of storage, or where this has been provided for by the European legislator or another legislator in laws or regulations to which the controller is subject.
If the purpose of storage no longer applies, or if a storage period prescribed by the European legislator or another competent legislator expires, the personal data is routinely blocked or erased in accordance with the statutory provisions.
9. Rights of the data subject
-
a) Right to confirmation
Every data subject has the right, granted by the European legislator, to obtain confirmation from the controller as to whether personal data concerning them is being processed. If a data subject wishes to exercise this right to confirmation, they can contact an employee of the controller at any time.
-
b) Right of access
Every data subject affected by the processing of personal data has the right, granted by the European legislator, to obtain from the controller at any time, free of charge, information about the personal data stored about them and a copy of this information. Furthermore, the European legislator has granted the data subject access to the following information:
-
the purposes of the processing
-
the categories of personal data being processed
-
the recipients or categories of recipients to whom the personal data has been or will be disclosed, in particular recipients in third countries or international organisations
-
where possible, the planned period for which the personal data will be stored or, if this is not possible, the criteria used to determine that period
-
the existence of a right to rectification or erasure of the personal data concerning them, or to restriction of processing by the controller, or a right to object to such processing
-
the existence of a right to lodge a complaint with a supervisory authority
-
where the personal data is not collected from the data subject: all available information about the source of the data
-
the existence of automated decision-making, including profiling, pursuant to Article 22 (1) and (4) GDPR and — at least in those cases — meaningful information about the logic involved, as well as the significance and envisaged consequences of such processing for the data subject
Furthermore, the data subject has a right to know whether personal data has been transferred to a third country or to an international organisation. If this is the case, the data subject also has the right to obtain information about the appropriate safeguards in connection with the transfer.
If a data subject wishes to exercise this right of access, they can contact an employee of the controller at any time.
-
c) Right to rectification
Every data subject affected by the processing of personal data has the right, granted by the European legislator, to demand the immediate rectification of inaccurate personal data concerning them. Furthermore, the data subject has the right, taking into account the purposes of the processing, to have incomplete personal data completed — including by means of a supplementary statement.
If a data subject wishes to exercise this right to rectification, they can contact an employee of the controller at any time.
-
d) Right to erasure (right to be forgotten)
Every data subject affected by the processing of personal data has the right, granted by the European legislator, to require the controller to erase the personal data concerning them without undue delay, where one of the following grounds applies and insofar as the processing is not necessary:
-
The personal data were collected or otherwise processed for purposes for which they are no longer necessary.
-
The data subject withdraws their consent on which the processing was based pursuant to Art. 6 para. 1 point (a) GDPR or Art. 9 para. 2 point (a) GDPR, and there is no other legal basis for the processing.
-
The data subject objects to the processing pursuant to Art. 21 para. 1 GDPR and there are no overriding legitimate grounds for the processing, or the data subject objects to the processing pursuant to Art. 21 para. 2 GDPR.
-
The personal data have been unlawfully processed.
-
The erasure of the personal data is necessary for compliance with a legal obligation under Union law or the law of the Member States to which the controller is subject.
-
The personal data have been collected in relation to the offer of information society services pursuant to Art. 8 para. 1 GDPR.
If one of the above grounds applies and a data subject wishes to have personal data stored by YOUNGSTAR TRAVEL GmbH erased, they can contact an employee of the controller at any time. The employee of YOUNGSTAR TRAVEL GmbH will ensure that the erasure request is complied with without undue delay.
If the personal data have been made public by YOUNGSTAR TRAVEL GmbH and our company, as controller, is obliged to erase the personal data pursuant to Art. 17 para. 1 GDPR, YOUNGSTAR TRAVEL GmbH, taking account of the available technology and the cost of implementation, will take reasonable steps, including technical measures, to inform other controllers processing the published personal data that the data subject has requested from those other controllers the erasure of all links to, or copies or replications of, those personal data, insofar as the processing is not necessary. The employee of YOUNGSTAR TRAVEL GmbH will arrange the necessary steps in each individual case.
-
e) Right to restriction of processing
Every data subject affected by the processing of personal data has the right, granted by the European legislator, to obtain from the controller restriction of processing where one of the following applies:
-
The accuracy of the personal data is contested by the data subject, for a period enabling the controller to verify the accuracy of the personal data.
-
The processing is unlawful and the data subject opposes the erasure of the personal data and requests the restriction of their use instead.
-
The controller no longer needs the personal data for the purposes of the processing, but the data subject needs them for the establishment, exercise or defence of legal claims.
-
The data subject has objected to the processing pursuant to Art. 21 para. 1 GDPR and it is not yet certain whether the legitimate grounds of the controller override those of the data subject.
If one of the above conditions is met and a data subject wishes to request the restriction of personal data stored by YOUNGSTAR TRAVEL GmbH, they can contact an employee of the controller at any time. The employee of YOUNGSTAR TRAVEL GmbH will arrange the restriction of processing.
-
f) Right to data portability
Every data subject affected by the processing of personal data has the right, granted by the European legislator, to receive the personal data concerning them, which the data subject has provided to a controller, in a structured, commonly used and machine-readable format. They also have the right to transmit those data to another controller without hindrance from the controller to which the personal data have been provided, where the processing is based on consent pursuant to Art. 6 para. 1 point (a) GDPR or Art. 9 para. 2 point (a) GDPR, or on a contract pursuant to Art. 6 para. 1 point (b) GDPR, and the processing is carried out by automated means, unless the processing is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller.
Furthermore, in exercising their right to data portability pursuant to Art. 20 para. 1 GDPR, the data subject has the right to have the personal data transmitted directly from one controller to another, where technically feasible and where this does not adversely affect the rights and freedoms of others.
To assert the right to data portability, the data subject can contact an employee of YOUNGSTAR TRAVEL GmbH at any time.
-
g) Right to object
Every data subject affected by the processing of personal data has the right, granted by the European legislator, to object at any time, on grounds relating to their particular situation, to the processing of personal data concerning them which is carried out on the basis of Art. 6 para. 1 points (e) or (f) GDPR. This also applies to profiling based on those provisions.
In the event of an objection, YOUNGSTAR TRAVEL GmbH will no longer process the personal data, unless we can demonstrate compelling legitimate grounds for the processing which override the interests, rights and freedoms of the data subject, or the processing serves the establishment, exercise or defence of legal claims.
If YOUNGSTAR TRAVEL GmbH processes personal data for direct marketing purposes, the data subject has the right to object at any time to the processing of the personal data for such marketing. This also applies to profiling to the extent that it is related to such direct marketing. If the data subject objects to YOUNGSTAR TRAVEL GmbH to processing for direct marketing purposes, YOUNGSTAR TRAVEL GmbH will no longer process the personal data for these purposes.
In addition, the data subject has the right, on grounds relating to their particular situation, to object to the processing of personal data concerning them which is carried out at YOUNGSTAR TRAVEL GmbH for scientific or historical research purposes or for statistical purposes pursuant to Art. 89 para. 1 GDPR, unless such processing is necessary for the performance of a task carried out in the public interest.
To exercise the right to object, the data subject can contact any employee of YOUNGSTAR TRAVEL GmbH or another employee directly. In the context of the use of information society services, and notwithstanding Directive 2002/58/EC, the data subject is also free to exercise their right to object by automated means using technical specifications.
-
h) Automated individual decision-making, including profiling
Every data subject affected by the processing of personal data has the right, granted by the European legislator, not to be subject to a decision based solely on automated processing — including profiling — which produces legal effects concerning them or similarly significantly affects them, unless the decision
(1) is not necessary for entering into, or the performance of, a contract between the data subject and the controller, or
(2) is authorised by Union or Member State law to which the controller is subject and which also lays down suitable measures to safeguard the data subject's rights and freedoms and legitimate interests, or
(3) is based on the data subject's explicit consent.
If the decision
(1) is necessary for entering into or performing a contract between the data subject and the controller, or
(2) is made with the data subject's explicit consent, YOUNGSTAR TRAVEL GmbH shall implement suitable measures to safeguard the rights and freedoms and the legitimate interests of the data subject, which include at least the right to obtain human intervention on the part of the controller, to express his or her point of view and to contest the decision.
If the data subject wishes to exercise rights relating to automated decisions, they may contact an employee of the controller at any time.
-
i) Right to withdraw consent under data protection law
Every data subject affected by the processing of personal data has the right, granted by the European legislator, to withdraw consent to the processing of personal data at any time.
If the data subject wishes to exercise their right to withdraw consent, they may contact an employee of the controller at any time.
10. Data protection in applications and the application process
The controller collects and processes the personal data of applicants for the purpose of handling the application process. Processing may also take place electronically. This is the case in particular where an applicant submits the relevant application documents to the controller electronically, for example by email or via a web form on the website. If the controller enters into an employment contract with an applicant, the data submitted will be stored for the purpose of administering the employment relationship in compliance with the statutory provisions. If the controller does not enter into an employment contract with the applicant, the application documents will be deleted automatically two months after notification of the decision to reject the application, provided that no other legitimate interests of the controller oppose deletion. Another legitimate interest in this sense is, for example, a duty to provide evidence in proceedings under the German General Equal Treatment Act (AGG).
19. Legal basis for processing
Art. 6 I lit. a GDPR serves as the legal basis for processing operations for which we obtain consent for a specific processing purpose. If the processing of personal data is necessary for the performance of a contract to which the data subject is a party, as is the case, for example, with processing operations necessary for the supply of goods or the provision of any other service or consideration, the processing is based on Art. 6 I lit. b GDPR. The same applies to processing operations necessary for carrying out pre-contractual measures, for example in the case of enquiries about our products or services. If our company is subject to a legal obligation that requires the processing of personal data, for example to fulfil tax obligations, the processing is based on Art. 6 I lit. c GDPR. In rare cases, the processing of personal data may become necessary to protect the vital interests of the data subject or of another natural person. This would be the case, for example, if a visitor were injured on our premises and their name, age, health insurance details or other vital information had to be passed on to a doctor, a hospital or other third parties. The processing would then be based on Art. 6 I lit. d GDPR. Finally, processing operations could be based on Art. 6 I lit. f GDPR. This legal basis covers processing operations that are not covered by any of the aforementioned legal bases, if processing is necessary for the purposes of the legitimate interests pursued by our company or by a third party, except where such interests are overridden by the interests, fundamental rights and freedoms of the data subject. We are permitted to carry out such processing operations in particular because they have been specifically mentioned by the European legislator. In that regard, it took the view that a legitimate interest could be assumed where the data subject is a customer of the controller (Recital 47, sentence 2 GDPR).
20. Legitimate interests in the processing pursued by the controller or a third party
Where the processing of personal data is based on Article 6 I lit. f GDPR, our legitimate interest is the conduct of our business for the benefit of the well-being of all our employees and our shareholders.
21. Period for which the personal data will be stored
The criterion for the period of storage of personal data is the respective statutory retention period. Once that period has expired, the relevant data is routinely deleted, provided it is no longer required for the performance or initiation of a contract.
22. Statutory or contractual requirements to provide personal data; necessity for the conclusion of a contract; obligation of the data subject to provide the personal data; possible consequences of failure to provide it
We inform you that the provision of personal data is partly required by law (e.g. tax regulations) or may also result from contractual provisions (e.g. information about the contractual partner). It may sometimes be necessary for the conclusion of a contract that a data subject provides us with personal data, which we must then process. For example, the data subject is obliged to provide us with personal data when our company concludes a contract with them. Failure to provide the personal data would mean that the contract with the data subject could not be concluded. Before providing personal data, the data subject must contact one of our employees. Our employee will inform the data subject on a case-by-case basis whether the provision of the personal data is required by law or contract or is necessary for the conclusion of the contract, whether there is an obligation to provide the personal data, and what the consequences of failure to provide the personal data would be.
23. Existence of automated decision-making
As a responsible company, we do not use automatic decision-making or profiling.
